NeuroDx (“NeuroDx,” “we,” “us,” or “our”) respects your privacy.
This SMS & Text Messaging Privacy Policy describes how we collect, use, disclose, retain, and protect information associated with SMS and MMS communications between NeuroDx and individuals who communicate with us by text message.
This policy applies specifically to text messaging and supplements any other privacy policy, Notice of Privacy Practices, terms of use, or other privacy notice that may apply to your relationship with NeuroDx.
1. Scope of This Policy
This policy applies to information collected when you:
- Provide NeuroDx with a mobile telephone number
- Opt in to receive text messages
- Communicate with NeuroDx by SMS or MMS
- Respond to a NeuroDx text message
- Request appointment or service information through text messaging
- Use an SMS keyword or other messaging enrollment process
- Change your text messaging preferences
- Opt out of text messaging
2. Information We May Collect
When you participate in NeuroDx text messaging, we may collect or maintain information including:
Contact Information
- Name
- Mobile telephone number
- Other contact information you provide
Consent Information
We may maintain records regarding:
- Whether you consented to receive text messages
- The date and time consent was provided
- The method through which consent was provided
- The type of messages you agreed to receive
- Changes to your communication preferences
- Opt-out requests
- Re-enrollment or renewed consent
Messaging Information
We may collect or maintain:
- Text messages sent to you
- Text messages received from you
- Date and time of messages
- Message status
- Delivery status

3. How We Use SMS Information
NeuroDx may use information associated with text messaging to:
- Send appointment confirmations and reminders
- Communicate regarding scheduling or rescheduling
- Respond to inquiries
- Provide requested information
- Provide customer, patient, or administrative support
- Send service-related notifications
- Communicate regarding registration or intake
- Send account or billing-related notifications where appropriate
- Confirm communication preferences
- Process opt-in and opt-out requests
- Provide technical support
- Maintain records of consent
- Prevent unwanted messages
- Prevent fraud or misuse
- Protect the security and integrity of our systems
- Comply with applicable laws, regulations, carrier requirements, and industry standards
- Establish, exercise, or defend legal rights
- Fulfill other purposes disclosed at the time you provide consent
We will use SMS information only for legitimate purposes consistent with your consent, our relationship with you, and applicable law.
4. Mobile Information Will Not Be Shared for Marketing
NeuroDx will not sell, rent, share, transfer, or disclose your mobile telephone number, SMS opt-in information, or SMS consent information to third parties or affiliates for their marketing or promotional purposes.
SMS consent is not shared with third parties or affiliates for marketing purposes.
Your mobile information may be provided to service providers solely when reasonably necessary to provide services on behalf of NeuroDx, such as transmitting messages, managing messaging infrastructure, maintaining telecommunications systems, or supporting our operations.
Those service providers are not permitted by NeuroDx to use your mobile telephone number or SMS consent for their own independent marketing or promotional purposes.
This restriction on sharing mobile information applies regardless of any broader provisions concerning information sharing that may appear elsewhere in a NeuroDx privacy policy.
5. Service Providers
NeuroDx may use third-party companies to support our text messaging services.
These may include:
- Telecommunications carriers
- SMS and MMS platforms
- Cloud communications providers
- Technology providers
- Information technology providers
- Security providers
- Scheduling or practice-management providers
- Customer or patient communication platforms
- Other vendors necessary to support NeuroDx operations
These parties may process information only as reasonably necessary to perform services for NeuroDx or as otherwise permitted or required by law.
Where appropriate, NeuroDx requires vendors to maintain reasonable confidentiality, privacy, and security safeguards.
6. Other Permitted Disclosures
In addition to disclosures to service providers, NeuroDx may disclose information when reasonably necessary or required to:

- Protect the rights, property, or safety of NeuroDx, our patients, customers, employees, or others
- Investigate fraud, abuse, security incidents, or unlawful activity

Nothing in this section permits NeuroDx to sell or share mobile numbers or SMS consent information with third parties or affiliates for their marketing or promotional purposes.
7. Healthcare Information
Because NeuroDx may provide healthcare-related services, some communications may contain or relate to health information.
Where information is subject to healthcare privacy laws or other specific privacy requirements, NeuroDx will handle that information in accordance with applicable law and applicable NeuroDx privacy notices.
This SMS Privacy Policy does not replace any Notice of Privacy Practices that may separately apply to protected health information.
8. SMS Is Not a Fully Secure Communication Method
Standard SMS and MMS communications generally are not end-to-end encrypted and may travel through telecommunications systems outside NeuroDx’s control.
Accordingly, there are privacy risks associated with text messaging.
For example:
- Messages may appear on a device’s lock screen
- Other individuals may have access to your telephone
- Messages may synchronize to tablets, computers, smart watches, or other connected devices
- Mobile carriers or messaging providers may retain message information
- Messages may be backed up automatically
- Messages may be forwarded, copied, photographed, or otherwise disclosed by someone with access to your device
By electing to communicate with NeuroDx through standard text messaging, you acknowledge these inherent risks.
Where appropriate, NeuroDx may direct you to a secure portal, telephone call, or another communication method for particularly sensitive information.
9. Protecting Your Privacy
You can help protect the confidentiality of text communications by:
- Using a passcode, password, biometric lock, or other security feature on your mobile device
- Disabling message previews on your lock screen
- Preventing unauthorized individuals from accessing your phone
- Reviewing which devices synchronize with your messaging account
- Promptly notifying us if your telephone number changes
- Avoiding sending highly sensitive information through SMS unless specifically requested through an appropriate process
10. Sensitive Information
Unless specifically requested through an appropriate NeuroDx process, please do not send highly sensitive information through standard text messages.
Examples include:
- Social Security numbers
- Passwords
- Login credentials
- Full payment card numbers
- Bank account information
- Copies of identification documents
- Detailed medical records
- Highly sensitive health information
NeuroDx may redirect a conversation to a more appropriate or secure communication channel when necessary.
11. No Medical Emergencies by Text
Text messaging should not be used for emergency medical situations or urgent medical advice.
If you are experiencing a medical emergency, call 911 or seek emergency medical care immediately.
NeuroDx does not guarantee that incoming text messages will be monitored continuously or reviewed within a particular period of time.
You should not delay obtaining medical care because you are waiting for a response to an SMS message.
12. Consent and Choice
NeuroDx sends SMS communications in accordance with the consent you have provided and applicable law.
You may choose not to receive text communications.
Consent to receive text messages is not a condition of purchasing goods or services from NeuroDx.
Choosing not to receive text messages does not prevent you from receiving NeuroDx services, although we may need to communicate with you through another available method.
13. Message Frequency
Message frequency varies.
The number of messages you receive depends on your relationship and interactions with NeuroDx, including appointment activity, scheduling, requests, services, and communications with our staff.
14. Message and Data Rates
Message and data rates may apply.
Your wireless carrier’s standard messaging, data, and other charges may apply to messages sent or received through NeuroDx SMS communications.
NeuroDx is not responsible for charges imposed by your carrier.
15. Opting Out of Text Messages
You may withdraw your consent to receive NeuroDx text messages at any time.
Reply:
STOP
to a NeuroDx text message to opt out.
We may also recognize other reasonable expressions of an opt-out request.
After you opt out, NeuroDx may send one final confirmation message acknowledging that your request has been processed.
You may also contact NeuroDx directly to request removal from SMS communications.
Opting out of SMS does not prevent us from contacting you through other legally permitted methods.

17. Data Retention
NeuroDx may retain information associated with SMS communications for as long as reasonably necessary to:
- Provide services

- Comply with legal and regulatory obligations
- Resolve disputes
- Maintain security
- Prevent unwanted communications
- Establish, exercise, or defend legal claims
- Meet legitimate operational requirements
Retention periods may vary depending on the nature of the information and applicable legal requirements.
18. Data Security
NeuroDx uses reasonable administrative, technical, and organizational safeguards designed to protect information under our control from unauthorized access, use, alteration, loss, or disclosure.
However, no communication or information system can be guaranteed to be completely secure.
Because standard SMS transmission depends on telecommunications providers and devices outside our control, NeuroDx cannot guarantee the security of information while it is being transmitted through SMS.
19. Telephone Number Changes and Reassignment
Telephone numbers may be disconnected or reassigned to other individuals.
If the mobile number you provided to NeuroDx changes or is no longer under your control, please notify us promptly or opt out before discontinuing the number.
We may use reasonable processes or services to identify deactivated or reassigned numbers and discontinue messages where appropriate.
20. Children’s and Minors’ Information
NeuroDx does not knowingly obtain SMS consent directly from a minor when parental, guardian, or other legally authorized consent is required by applicable law.
If a parent, guardian, or legally authorized representative provides a telephone number for communications relating to a minor, NeuroDx may communicate with that authorized individual
