These SMS Terms & Conditions (“SMS Terms”) govern text messages sent by or on behalf of NeuroDx (“NeuroDx,” “we,” “us,” or “our”) to individuals who have provided a mobile telephone number and consented to receive text messages from us.

By opting in to receive SMS or MMS messages from NeuroDx, you acknowledge that you have read, understand, and agree to these SMS Terms.

These SMS Terms supplement any other terms, privacy policies, notices, or agreements that may apply to your relationship with NeuroDx.

1. SMS Program Description

NeuroDx may use SMS and MMS text messaging to communicate with individuals regarding our services and their interactions with NeuroDx.

Depending on your relationship with us and the consent you have provided, messages may include:

  • Appointment confirmations
  • Appointment reminders
  • Scheduling and rescheduling communications
  • Registration or intake reminders
  • Service-related notifications
  • Patient or customer support communications
  • Requests to contact our office
  • Administrative notifications
  • Billing or account-related notifications
  • Follow-up communications
  • Status updates
  • Responses to inquiries initiated by you
  • Other informational or transactional communications related to NeuroDx services
  • Other communications for which you have specifically provided consent

NeuroDx will not use your enrollment in an informational or transactional SMS program as permission to send unrelated marketing or promotional text messages unless you have separately consented to receive such messages where required by law.

2. Consent to Receive Text Messages

You may consent to receive text messages from NeuroDx through one or more methods, including:

  • Providing your mobile telephone number through a NeuroDx website or online form
  • Selecting or checking an SMS consent option
  • Providing consent during registration or intake
  • Providing consent during scheduling
  • Providing written consent
  • Providing consent through another documented enrollment process
  • Initiating a text conversation with NeuroDx where permitted
  • Using an authorized SMS opt-in keyword, if offered by NeuroDx

By opting in, you authorize NeuroDx and service providers acting on our behalf to send text messages to the mobile telephone number you provided.

Your consent applies only to communications from NeuroDx and the specific messaging purposes for which you provided consent.

Consent to receive text messages is not a condition of purchasing goods or services from NeuroDx.

Where required by applicable law, we will obtain any additional consent required before sending marketing or promotional communications.

3. Message Frequency

Message frequency varies.

The number of messages you receive will depend on your interactions with NeuroDx, including your appointments, requests, services, account activity, and communications with our staff.

You may receive multiple messages in connection with a particular appointment, service, request, or ongoing interaction.

4. Message and Data Rates

Message and data rates may apply.

NeuroDx does not charge you for receiving text messages from us. However, your wireless carrier may impose message, data, or other charges under your mobile service plan.

You are solely responsible for charges imposed by your wireless carrier.

Contact your wireless carrier if you have questions regarding your messaging or data plan.

5. How to Opt Out

You may withdraw your consent to receive text messages from NeuroDx at any time.

To stop receiving SMS messages, reply:

STOP

to any NeuroDx text message.

We may also recognize other customary opt-out requests, such as:

  • CANCEL
  • END
  • QUIT
  • UNSUBSCRIBE
  • OPT OUT

You may also contact NeuroDx directly and request that text messaging be discontinued.

After submitting an opt-out request, you may receive one final text message confirming that your opt-out request has been processed.

After your opt-out has been processed, we will not send additional messages through that SMS program unless you subsequently provide consent to receive messages again or initiate a new communication with us where a response is permitted by law.

Opting out of text messaging does not prevent NeuroDx from contacting you through other methods when permitted or required, including telephone, email, mail, patient portals, or other communication channels.

7. Mobile Number and Consent Privacy

NeuroDx respects the privacy of your mobile information.

Mobile telephone numbers, SMS opt-in information, and SMS consent information will not be sold, rented, shared, or disclosed to third parties or affiliates for their marketing or promotional purposes.

We may disclose mobile information to service providers, telecommunications providers, messaging platforms, technology vendors, and other parties that assist us in delivering and operating our messaging services, but only as reasonably necessary to provide those services or as otherwise permitted or required by law.

Such service providers are not authorized to use your mobile information for their own independent marketing or promotional purposes.

SMS consent is specific to NeuroDx and is not transferable to unaffiliated third parties for their marketing purposes.

8. Healthcare and Medical Communications

Some NeuroDx communications may relate to healthcare services, appointments, testing, scheduling, or other health-related matters.

Text messaging is intended primarily as a communication convenience and should not be relied upon for medical emergencies, urgent medical advice, diagnosis, or treatment.

Do not use SMS to communicate an emergency or urgent medical condition.

If you believe you are experiencing a medical emergency, call 911 or seek appropriate emergency medical care.

Text messages are not continuously monitored, and delivery of a message does not mean that NeuroDx has received, reviewed, or acted upon it.

You should not delay seeking medical attention because you are awaiting a response to a text message.

9. Privacy and Security of SMS

Standard SMS and MMS messaging may not be encrypted and may not provide the same level of privacy or security as certain secure healthcare communication systems.

Text messages may be:

  • Visible on a locked device
  • Viewed by anyone who has access to your phone
  • Stored by your wireless carrier or messaging provider
  • Included in device backups
  • Forwarded or copied by a recipient
  • Accessible through devices connected to your mobile account

By choosing to communicate with NeuroDx through SMS, you acknowledge the inherent privacy limitations associated with standard text messaging.

You are responsible for maintaining the privacy and security of your mobile device and telephone number.

If you share a phone, use a family mobile plan, permit others to access your device, or have messages displayed on a connected device, other individuals may be able to view communications sent by NeuroDx.

Where appropriate, NeuroDx may limit the amount or type of sensitive information transmitted through SMS and may direct you to a more secure communication method.

10. Sensitive Information

Unless specifically instructed by an authorized NeuroDx representative, you should not send highly sensitive information through standard SMS.

This may include:

  • Social Security numbers
  • Financial account numbers
  • Payment card information
  • Passwords or authentication credentials
  • Detailed medical records
  • Highly sensitive health information
  • Copies of identification documents
  • Other confidential information that is not necessary for the communication

NeuroDx may redirect a conversation to a telephone call, secure portal, encrypted communication method, or other appropriate channel when necessary.

11. No Guarantee of Delivery

SMS communications are provided through third-party wireless carriers, telecommunications networks, messaging platforms, internet service providers, and other systems outside NeuroDx’s direct control.

NeuroDx does not guarantee that any text message will be:

  • Delivered
  • Delivered on time
  • Complete
  • Error-free
  • Free from interruption
  • Available through every carrier or device

Messages may be delayed, blocked, filtered, duplicated, corrupted, or otherwise affected by circumstances outside our control.

NeuroDx is not responsible for delays or failures caused by your carrier, equipment, telecommunications networks, messaging providers, internet providers, device settings, spam filters, or similar third-party systems.

12. Supported Carriers and Devices

SMS availability may depend on your wireless carrier, mobile device, geographic location, and service plan.

Not all carriers, devices, or service plans support all messaging features.

You are responsible for ensuring that the mobile number provided to NeuroDx is capable of receiving text messages.

13. Providing an Accurate Mobile Number

You represent that:

  • The mobile telephone number you provide belongs to you or you are authorized to use it;
  • You are authorized to consent to receiving communications at that number; and
  • The information you provide is accurate and current.

If your mobile telephone number changes, is reassigned, is disconnected, or is no longer under your control, you should promptly notify NeuroDx or opt out before discontinuing use of the number.

You should not provide a telephone number belonging to another individual without authorization.

14. Reassigned or Deactivated Numbers

Mobile telephone numbers may be reassigned by wireless carriers.

If you stop using a mobile number previously provided to NeuroDx, you agree to take reasonable steps to notify us.

NeuroDx may use commercially reasonable measures to identify deactivated or reassigned telephone numbers and discontinue messaging where appropriate.

15. Age and Authority

You may only enroll a mobile telephone number in NeuroDx SMS services if you are legally authorized to provide consent for communications to that number.

If you are providing a number on behalf of another person, including a dependent, patient, minor, or individual for whom you are legally authorized to act, you represent that you have appropriate authority to do so.

16. Changes to Your Communication Preferences

You may change your communication preferences at any time by contacting NeuroDx.

Choosing not to receive SMS communications may mean that certain notifications will be provided through another available method.

Your decision to opt out of SMS will not affect your eligibility to receive NeuroDx services.

17. Third-Party Messaging Providers

NeuroDx may use third-party technology and telecommunications providers to transmit, manage, route, or process text messages.

Those providers may process information necessary to deliver communications, including:

  • Your mobile telephone number
  • Message routing information
  • Delivery information
  • Date and time information
  • Message content where necessary to transmit communications
  • Opt-in and opt-out status
  • Technical information associated with message delivery

Such processing is subject to applicable contractual, legal, privacy, and security requirements.

NeuroDx does not authorize messaging providers to use your SMS consent or mobile number for their own marketing or promotional purposes.

18. Records of Consent and Communications

NeuroDx may retain records relating to its SMS program, including:

  • The mobile number provided
  • The date and method of consent
  • The scope of consent
  • Messages sent or received
  • Opt-out requests
  • HELP requests
  • Delivery information
  • Other information reasonably necessary to document compliance and operate the messaging program

Records will be retained consistent with applicable law, NeuroDx policies, and legitimate business or healthcare recordkeeping requirements.

19. Prohibited Use

You may not use NeuroDx’s text messaging services to:

  • Send unlawful, abusive, threatening, fraudulent, or harassing content
  • Impersonate another person
  • Interfere with NeuroDx systems
  • Attempt unauthorized access to systems or accounts
  • Transmit malicious software or harmful code
  • Engage in any activity prohibited by applicable law

NeuroDx may restrict or discontinue text communications in response to misuse, security concerns, suspected fraud, or unlawful activity.

20. Changes to These SMS Terms

NeuroDx may update these SMS Terms periodically to reflect changes in:

  • Our services
  • Messaging practices
  • Technology
  • Carrier requirements
  • Applicable laws or regulations
  • Privacy or security practices

When these SMS Terms are updated, the revised version will be posted on our website and the “Last Updated” date will be changed.

Your continued participation in an SMS program after an update is subject to applicable law and any consent requirements that may apply.

21. Relationship to Other Policies

These SMS Terms should be read together with NeuroDx’s:

  • Website Terms of Use, if applicable
  • Applicable patient notices or healthcare privacy notices, if applicable

If another NeuroDx policy provides greater privacy protection for information subject to that policy, the more protective requirement will apply to the extent required by law.
